Terms and Conditions
By submission of an award entry, or otherwise participating in the Surface Travel Awards, Representatives agree to be bound by these Terms and Conditions, including all eligibility requirements.
Eligibility
Awards are only open to business entities and/or individuals which designed, created, grand-opened, and/or executed a three-dimensional project, image, or travel product completed (or will be completed) between June 1, 2017 and April 1, 2018 (“eligibility term”).
How to Qualify
If you meet the eligibility requirement, visit the The Surface Travel Awards website and follow instructions to complete and submit the Awards Entry Form (“Entry[ies]”) in its entirety along with the required processing fee/s, during the entry period, February 8, 2018-March 15, 2018.
Entry
Persons responsible for Entry submittal will be designated as the representative (“Representative”) and all Awards correspondence will be directed to the contact information provided by the Representative. Entries and supporting documents must be in English. Surface Travel Awards is not responsible for lost, late, misdirected or otherwise undeliverable Entries, or Entries that cannot be processed due to technical failures of any kind. All Entries and supporting documents become property of Surface Travel Awards and will not be returned. There is no limit on the number of unique Entries allowed per company during the entry period, and Entries may be submitted in multiple categories, additional fees will apply.In the event of a dispute over the identity of a Representative, or the ownership rights to the entry, the disputed entry will be disqualified at the sole discretion of Surface Travel Awards.
By entering, Representative grants Surface Travel Awards [Surface Media] the non-exclusive licence to publish, display, exhibit, digitize, or otherwise use all elements of the entry for any purpose, including but not limited to, advertising or promotion of the Surface Travel Awards, in perpetuity.
Surface Travel Awards reserves the right to disqualify any entry for any reason, at its sole discretion and is under no obligation to disclose why other than violation of these Terms and Conditions.
Surface Travel Awards reserves the right not to present an award for a category if in its discretion it does not receive a sufficient number of eligible and qualified entries for their respective category. Categories may be eliminated, renamed or combined at discretion of Surface Travel Awards.
Warranties
The Representative warrants:A. Representative has full authority and capacity to enter into this Agreement;
B. All elements of Entry[ies] submitted are original and are not copied from any other work and do not infringe upon the rights of any third party and/or business, and to the extent any elements were created by a third party (“Third Party Participant”), all necessary licenses and permissions have been obtained by the Representative from the Third Party Participant for their use;
C. Entry[ies] does not infringe upon the copyrights, trademarks, or other intellectual property rights of any other person or entity.
Judging
A panel of seven (7) or more jurors will be assembled by Surface Travel Awards will determine the best entry in each of the award categories. In the highly unlikely event of a tie, the two best entries in the category will win. The decisions of the judging panel are final and binding. The judging panel is under no obligation to provide comments on entries.
Awards
Award winners will be announced in July. Award recognition will be conveyed to each representative. Winners will have their winning entry along with information about their project published in the July/August Travel Issue of Surface.
General
By submitting an entry, you agree to accept these Terms and Conditions; you further agree to release, discharge, and hold harmless Surface Travel Awards, its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and other individuals engaged in the development or execution of the Awards, from any liability, claims, losses, and damages arising out of or relating to your participation in the Awards or the acceptance, use, misuse, or possession of any prize received in the Awards.Eligibility Date or Entry Date (whichever clause it describes) subject to change.
Governing Law
Awards shall be governed by and interpreted under the laws of the State of New York.
